Scheibenberger faces ethics, misconduct charges

The Indiana Commission on Judicial Qualifications took formal disciplinary proceedings Tuesday against Allen Superior Judge Kenneth R. Scheibenberger.

Alleging the judge violated rules of judicial ethics and committed willful misconduct while in office, the four-count statement of charges outlines a verbal exchange between Scheibenberger and the family of a criminal defendant.

On Nov. 30, Scheibenberger, while still wearing his robe, went into the courtroom of Allen Superior Judge Fran Gull and sat down in the gallery to witness the sentencing of a man accused of a weapons violation, according to court documents.

As the hearing concluded, Scheibenberger approached an Allen County deputy prosecutor and “created a disturbance,” telling the deputy prosecutor the defendant was a “drug dealer and declared ‘upstanding citizen, my (expletive deleted)’ in reference to a comment he heard during the sentencing,” according to court documents.

Then he turned to the man’s parents, seated in the front row, asking them if they were “related to that piece of (expletive deleted)? ‘Upstanding citizen, my (expletive deleted)! He’ll get his!’

From the Indiana Rules of Court - Code of Judicial Conduct

CANON 2. A Judge Shall Avoid Impropriety and the Appearance of Impropriety in All the Judge’s Activities

A. A judge shall respect and comply with the law * and shall act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.

Whoa, Kenny must have forgotten about Canon 2. A, oh and Canon 4.

CANON 4. A Judge Shall so Conduct the Judge’s Extra-Judicial Activities as to Minimize the Risk of Conflict With Judicial Obligations

A. Extra-judicial Activities in General. A judge shall conduct all of the judge’s extra-judicial activities so that they do not:

(1) cast reasonable doubt on the judge’s capacity to act impartially as a judge;
(2) demean the judicial office; or
(3) interfere with the proper performance of judicial duties.

[...]

Expressions of bias or prejudice by a judge, even outside the judge’s judicial activities, may cast reasonable doubt on the judge’s capacity to act impartially as a judge. Expressions which may do so include jokes or other remarks demeaning individuals on the basis of their race, sex, religion, national origin, disability, age, sexual orientation or socioeconomic status.

Scheibenberger could end up being removed from the bench. If so, I believe Mitch Daniels will have to appoint a replacement. That might make Mr. Kelty very happy.

  1. you mean oru crooked, incompetent, ignorant gop judges in alen county- the ones who turned a blind eye to the cherrymaster racket for all these years- you mean those Piece of hit judges?

  2. I thought judges were supposed to be neutral. Maybe in his case neutered. I wonder if he has already determined the verdict in Kelty’s case.

  3. Jim Howard says:

Judges are supposed to be nuetral and respectful of the office that they represent. They carry a mantel entrusted to them by the Citizens of Allen County. A trial is a right, an inalienable right, as it is so closely tied with liberty. Words matter and care should be exercised in just saying what is on your mind, especially as a member of the judiciary. I can not criticize Judge Schiebenberger because I was not there and I have no accurate idea as to what exactly transpired. I can, though, rearticulate the responsibilities of both judiciary and attorneys in the Courtroom. Flippancy has no place from attorney or Judge within the four walls of the Courtroom. The “robes” should be honored and the Courtroom should be approached with seriousness, particularly when it involves discussion of Crimes that have physically injured people.

There is far too much nonsense that happens within the Courtroom in our Country.

  4. While I can sympathize with Kenny’s “interest” in this drug dealing thug (his son died last year from involvement with drugs), Our dear judge (one would think) is supposed to be ABOVE reproach.

Such just ain’t the case with Kenny.
    The boy does have issues.

Aside from the alcohol-related problem last year, Judge Kenny has had a history of letting felons off E-A-S-Y!
He must have cried the blues when Robert (I lost all the court records) Gevers left the prosecutor’s office, but smiled ear-to-ear when Gevers became a public defender!
I nicknamed him: “Turn Em Loose Kenny” (with good reason).
And with few exceptions, guess WHAT part of Ft. Wayne these felons were turned loose TO?
    You guessed it…

I suppose it could be worse…we could have something akin to the 9th circuit court of the Socialist Republic of Kalifornia (sic).

Maybe it’s time we allow him to step down.
