I got a lawyer letter today from a mouthpiece here in town that represents the Journal Gazette.

They want me to take down the picture of Doc Crawfish and Marty Bender where I allowed you to parody them by “writing your own caption”. Sorry Mr. Lawyer, that’s protected under the fair use doctrine. They did pitch a fit over another image/picture which I’ve since taken off the Blog.

In most fair use/copyright cases it’s the person being parodied that sends in the clowns lawyers.

One thing that worries me is this. Fort Wayne Newspapers may be shaking in their collective boots with the new plethora of local Blogs of late. Since most all of us cite them almost on a daily basis what’s to stop them from threatening us to stop doing that as well? Nothing.

So, I’ve decided to have more fun since I suspect that maybe Mr. Crawfish may have started all this lawyer stuff. Here’s a re-do of the image and it’s once again “Write Your Own Caption” day at the AWB Blog!

  1. Doc, it’s head and *shoulders*, knees and toes–not head and *jowls*.

  2. AWB, you must have touched a nerve or two, eh? Shred the mouthpiece’s letter and mail it back to ‘em.

    Shakespeare was right!

  8. Attaboy, AWB!
    warning- proper context, and definitions
Tell Dick Inskeep, the “media-“, and his “tabloid-” daughter Julie Inskeep; publishers of the local tabloid “Defamer”
where they can go, and what they can do on the way. The defamed, and libeled me, and it wasnt parody- they pretend to be a “serious newspaper”.
blog opinions are protected speech- read the laws..
I guess the Hypocrites at Fort Waste newspapers, and the people who own, run, and control everything dont like all us dissident little Gutenbergs, with our global little printing presses to start telling the truth about them, and this little totalitarian regime called Allen County?
dish the dirt on your favorite target. I’ll publish it- free!

I guess free speech isnt free, Only the rich can say and do what they want.
Read Hustler V. Falwell. Parody is protected speech. so is the truth. If some stupid local jerk needs to have the truth told on him, then it is poetic justice. My life is an open e-mail blast, and blog. I cant be blackmailed, and I can pass a polygraph..
And If my opinion isnt politically correct, refer to Indiana Constitution Article 9. Fort Wayne Newspapers can kiss my A..
boycott their advertisers. cancel your subscription, unionize their carriers, and get all your news on-line, and with blogs..
Revenge is sweet. “Local Newspaper will work for food”…

If the Publishers and editors of the Journal-Gazette, can drag Roach thorugh the Mud, and defame me, and not apologize, or retract; then they need to shut the … up.
As JC said “let him who is without guilt cast the first stone. Ouch! Who threw that? Mother! I was trying to make a point…

  9. I also forgot to mention…

“A Strategic Lawsuit Against Public Participation (”SLAPP”) is a form of litigation filed by a large organization or in some cases an individual plaintiff, to intimidate and silence a less powerful critic by so severely burdening them with the cost of a legal defense that they abandon their criticism.”

    http://en.wikipedia.org/wiki/SLAPP

Indiana is one of the states with anti-SLAPP legislation.

They can only really bark and hope people don’t know these things.

(What can I say? Things like this amuse me.)
