At tonight’s city council meeting City Councilman Don Schmidt brought up a very valid point concerning Indiana Law and the acquisition of property for the Harrison Square project. Apparently what Mr. Schmidt is saying is the City of Fort Wayne violated Indiana law when acquiring the properties for Harrison Square.
I’ve already met with an attorney on this and this could likely turn into a situation where the property owners that are unsatisfied with the compensation they received from the city could turn the city on its head and ask for MORE money.
More research needs to be done on this and I will cite specific Indiana code and case-law precedents within the next day or two.
It looks like a public hearing is forthcoming.
For the record, the Blog Downtown Baseball had a professional photographer at the City Council meeting. This woman photographer that was taking the pictures asked me to move no less than 15 times so she could get a better shot and was the only one with this angle.
